California Consumer Privacy Act (CCPA) Notice – For California Residents
At Viral Rang, we value the privacy of all our users, including those in California. If you are a resident of California, you are entitled to certain rights regarding your personal information under the California Consumer Privacy Act (CCPA) (as amended by the California Privacy Rights Act, CPRA). This section explains what personal information we collect, how we use it, and your privacy rights as a California resident, and how you can exercise those rights.
Please note: This CCPA notice supplements our main Privacy Policy. In case of any conflict between this section and other parts of our Privacy Policy with respect to California residents, this section takes precedence for those users.
Information We Collect (Categories of Personal Information)
Under the CCPA, “personal information” is broadly defined as any information that identifies, relates to, describes, or could reasonably be linked with a particular consumer or household. In the past 12 months, Viral Rang may have collected the following categories of personal information from California consumers:
- Identifiers: Such as name, email address, IP address, or other online identifiers associated with you.
- Commercial Information: For instance, records of products or services purchased or considered, or other purchasing or consuming histories (this would apply if you engage in any transactions through affiliate links or consider products we feature).
- Internet or Network Activity: This includes browsing history, search history, and interactions with our Site or advertisements on the Site (e.g., which pages you visit, how long you stay, and which ads or links you click).
- Geolocation Data: Approximate location derived from your IP address or mobile device, if applicable.
- Inferences: Inferences drawn from the above data to create a profile about a consumer’s preferences (for example, inferring topics you may be interested in based on past reading behavior).
We do not knowingly collect sensitive personal information as defined under California law (such as Social Security numbers, driver’s license numbers, precise geolocation, etc.), as our Site’s content is informational and we generally do not require such details from users.
Sources of Personal Information
We collect personal information from several sources:
- Directly from You: For example, when you subscribe to our newsletter, fill out a contact form, or communicate with us, you provide personal details (like your name or email) directly to us.
- Automatically from Your Use of the Site: We use cookies and tracking technologies that automatically collect information about your interactions with our Site (such as your IP address and browsing behavior) as you visit pages. (See the “Cookies and Tracking” section of our Privacy Policy for more details.)
- Third Parties: We may receive information from third-party partners. For instance, our analytics providers (like Google Analytics) might provide us with aggregated information about usage of our Site, and affiliate programs might inform us when a purchase is made through one of our links. We do not buy consumer data from data brokers.
Business Purposes for Collecting and Using Personal Information
We collect and use personal information for the following business or commercial purposes (which are described in more detail in our Privacy Policy):
- Providing and Improving the Site: To operate our website and present content to you; to debug and fix errors; and to analyze how users interact with our Site so we can improve layout, content, and functionality.
- Personalization: To tailor your experience, such as showing you content or ads that match your interests or past reading history.
- Communication: To send newsletters or updates if you have subscribed, and to respond to your inquiries or requests.
- Advertising and Affiliate Tracking: To facilitate advertising (including interest-based ads) and affiliate commission tracking. For example, if you’re shown an ad through a third-party ad partner, we use personal information to ensure the ad is delivered properly and to measure its effectiveness. Similarly, if you click an affiliate link, we use data to ensure any resulting sale is credited properly.
- Security and Fraud Prevention: To detect and prevent malicious or fraudulent activity on our Site, and to keep our website safe and secure.
- Legal Compliance: To comply with applicable laws or regulatory requirements and to cooperate with law enforcement and regulatory inquiries, if necessary.
We will not collect additional categories of personal information or use the collected information for materially different, unrelated, or incompatible purposes without updating this notice and our Privacy Policy.
Sharing of Personal Information
Under the CCPA, “sharing” can include a broad range of scenarios. Viral Rang may share your personal information with third parties for business purposes, as described below:
- Service Providers: We share information with service providers who help us run our Site and business. For example, companies that provide website hosting, email newsletter distribution, analytics, or advertising services may receive personal information as needed to perform their functions. These service providers are bound by contracts that require them to use your information only for our purposes and to protect it.
- Affiliate and Advertising Partners: If you click on affiliate links or see ads on our Site, we may share (or allow third-party partners to collect) information such as cookie identifiers or advertising IDs for the purpose of tracking referrals and displaying ads. For instance, an affiliate partner needs to know that you made a purchase via our link so that we can get credit, which inherently involves sharing certain identifiers.
- Legal Disclosures: We may share information when required by law or to respond to legal process (such as a court order or subpoena), and to law enforcement or regulators if necessary to comply with legal obligations.
- Business Transfers: In the event of a merger, acquisition, or sale of our company or assets, personal information may be disclosed to the new owner as part of the transfer. The new entity would continue to honor your rights as described here.
Sale of Personal Information: Viral Rang does not sell your personal information for monetary compensation (we don’t provide your personal details to third parties in exchange for money). However, the CCPA defines “sell” or “share” more broadly to include certain types of data sharing for advertising benefits (for example, allowing ad networks to collect browsing data to personalize ads could be considered a “sale” under the CCPA’s definitions). While we don’t believe we engage in “sales” of data in the conventional sense, we respect your right to opt out of any potential “sale” or “sharing” of your personal information as defined by CCPA.
Your Rights Under the CCPA
If you are a California resident, the CCPA provides the following rights regarding your personal information:
- Right to Know: You have the right to request that we disclose what personal information we have collected about you in the past 12 months, including the categories of information, the sources of that information, the business purpose for collecting it, the categories of third parties with whom we share it, and the specific pieces of personal information we have about you. Essentially, you can ask for a report of the personal data we have about you and how we use and share it.
- Right to Delete: You have the right to request that we delete any personal information we collected from you, subject to certain exceptions. For example, we may deny deletion if the information is necessary to complete a transaction you requested, to detect security incidents, to comply with legal obligations, or for other exceptions allowed by law. If you delete your data, we will also direct our service providers to delete it from their records where required.
- Right to Opt-Out of Sale/Sharing: You have the right to opt out of the sale or sharing of your personal information to third parties. As noted, while we do not sell data for money, we honor opt-out requests related to any sharing of data that might be considered a “sale” under CCPA (like certain advertising cookies). We provide a “Do Not Sell or Share My Personal Information” option – you can exercise this by contacting us as described below, or by using any provided opt-out mechanisms on our Site.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we won’t deny you our services, charge you a different price, or provide a different level of quality just because you exercised your privacy rights. (However, please note that if you request deletion of certain data, some functionality – like a saved preference or an account – might no longer be available to you, which is a natural consequence of deletion and not discrimination.)
Additionally, as of the CPRA (effective 2023), California residents also have the right to correct inaccurate personal information and the right to limit use/disclosure of sensitive personal information. If those rights apply to any data we hold (for example, if you believe we have something incorrect about you, you can ask us to correct it), we will honor them as well.
How to Exercise Your CCPA Rights
Submitting Requests: If you are a California resident and want to exercise your Right to Know, Delete, or Correct, you may submit a request to us by emailing us at [email protected] with the subject line “CCPA Request”. Please specify in your request which right you seek to exercise and provide us sufficient information to verify your identity (such as your name, the email you used with us, and any interaction you’ve had with the Site that can help us identify your records).
For a Right to Opt-Out of Sale/Sharing, you can also email us or simply click the “Do Not Sell or Share My Personal Information” link (if available on our Site) and follow the instructions. You can also adjust cookie settings via our cookie banner or browser, as described in our Cookies Policy, to manage advertising cookies.
Verification: For your protection, we will need to verify your identity before fulfilling a personal information request. We may ask you to provide additional information to match against our records (we will only use this verification information for this purpose). For example, if you have signed up for our newsletter, we may ask you to confirm your email and perhaps provide an example of content you’ve accessed. If you request specific pieces of information or deletion of sensitive info, we may require a higher level of verification (such as a signed declaration) to ensure we are dealing with the correct individual.
If you use an authorized agent to submit a request on your behalf, we will require proof of the agent’s authority (e.g., a written permission from you or a power of attorney) and still take steps to verify your identity directly.
Response Time: We aim to respond to CCPA requests within 45 days as required by law. If we need more time (up to an additional 45 days, for a total of 90 days), we will inform you of the reason and extension in writing. Our response will cover the information required by the CCPA (for Right to Know requests) or confirm completion of your request (for deletions, etc.), or explain if we had to deny the request due to an applicable exception.
Cost: CCPA requests are generally free. We will not charge you a fee for processing your request unless it is excessive, repetitive, or manifestly unfounded. If a fee is warranted, we will explain why and provide a cost estimate before completing your request.
Do Not Sell or Share My Personal Information (Opt-Out)
As noted, we do not sell personal information for money. However, if you still wish to ensure that none of your personal data is “sold” or “shared” in the CCPA sense (for example, to third-party advertisers), you can take the following actions:
- Use the opt-out link or setting on our Site (if available) to record your preference.
- Contact us at [email protected] with a request to opt out. We will honor and record your preference in our systems.
- If your browser or device supports a Global Privacy Control (GPC) signal (a browser setting that communicates “do not sell or share” to websites), we recognize and honor that signal for California residents. If we detect such a signal, we will treat it as a valid opt-out request for the browser/device visiting our Site.
Once processed, we will refrain from selling or sharing your personal information unless you later provide consent for us to do so.
Updates to this CCPA Notice
We may update this CCPA Notice from time to time, for example, to reflect changes in our data practices or to comply with new legal requirements. When we make changes, we will update the “Last Updated” date below. If the changes are significant, we may provide a more prominent notice or ask for your consent as required by law.
We encourage you to review this notice periodically for any updates. Continued use of our Site after we make changes is deemed acceptance of those changes.
